Terms and Conditions for Sale
1. Warranties
Drone Amplified warrants that each Drone Amplified product purchased will be free from material and operational defects under normal use during the warranty period. Drone Amplified provides a limited warranty of one (1) year from the date of purchase.
If a product does not function as warranted during the warranty period, the buyer may obtain after-sales service by contacting Drone Amplified.
During the warranty period, Drone Amplified, at its sole discretion, will repair or replace faulty components with the same or similar suitable ones or, in cases where repair or replacement is not possible, provide a credit voucher. This is subject to the return and confirmation of the faulty components by Drone Amplified.
Any unauthorized modifications, whether software or hardware, will immediately void the warranty.
1.1 Warranty Exclusions
The warranty does not cover:
- Damage caused by crashes, fire, or other incidents resulting from non-manufacturing factors, including pilot error.
- Unauthorized modifications, disassembly, or use contrary to Drone Amplified’s instructions or manuals.
- Improper installation, incorrect use, or failure to follow operational guidelines.
- Unauthorized modifications to circuits, mismatched battery or charger use, or forced operation with aged or damaged components.
- Compatibility issues arising from the use of unauthorized third-party parts.
- Damage caused by operating the unit with a low-charged or defective battery.
- Loss or corruption of data resulting from product use.
- Software programs provided with or installed on the product.
- Damage resulting from non-Drone Amplified technical support or modifications.
2. Cancellation Policy
2.1 Order Cancellation
Orders may be canceled only with prior written consent from Drone Amplified. If a cancellation is approved, a 10% cancellation fee of the total order value will apply to cover administrative costs, restocking, and other expenses.
2.2 Exceptions and Discretion
- Custom Orders: Orders for custom-built products, special configurations, or items specifically procured for the customer cannot be canceled or refunded once production or procurement has commenced.
- Company Discretion: Drone Amplified reserves the right, at its sole discretion, to approve or deny any cancellation request, particularly for orders where significant materials, labor, or third-party commitments have been expended.
- Late-Stage Cancellations: For cancellations requested after the order has entered production or after specialized components have been ordered, additional fees may apply beyond the standard 10%, up to the full order value, to cover incurred costs.
2.3 Seller-Initiated Cancellations
Drone Amplified reserves the right to cancel any purchase order (PO) at its discretion. This may occur due to changes in business circumstances, product availability, pricing adjustments, or a customer’s failure to comply with agreed-upon terms and conditions. In such cases, Drone Amplified will notify the affected party promptly.
3. Compliance with Local and Federal Regulations
The purchaser may only operate Drone Amplified systems in compliance with all applicable local, state, and federal laws and regulations. This includes, but is not limited to:
- Federal Aviation Administration (FAA) requirements, including necessary waivers, exemptions, or certifications (e.g., Certificate of Waiver or Authorization (COA), Agricultural Operations Certificate (Part 137), or Public Aircraft Operator (PAO) status).
- State and local drone operation laws governing airspace usage, restricted zones, and operational safety.
- Any other permits, licenses, or authorizations required for the intended use of the system.
The purchaser assumes full responsibility for ensuring compliance with all applicable regulations before operating the system. Drone Amplified shall not be held liable for any violations of law or resulting penalties due to improper operation.
4. Precedence of Terms
These Terms and Conditions govern all sales and services provided by Drone Amplified and supersede any conflicting or additional terms and conditions set forth in any purchase order, confirmation, or other communication from the customer.
Any such conflicting or additional terms are expressly rejected unless specifically agreed to in writing by an authorized representative of Drone Amplified.
Acceptance of goods or services from Drone Amplified shall constitute acceptance of these Terms and Conditions.
5. Indemnification
The purchaser agrees to indemnify, defend, and hold harmless Drone Amplified, its affiliates, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorney fees) arising out of or related to:
- Any misuse, unauthorized modification, or illegal operation of the system.
- The purchaser’s failure to comply with local, state, or federal regulations.
- Any third-party claims resulting from the purchaser’s use of Drone Amplified products.
6. Force Majeure
Drone Amplified shall not be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, government actions, supply chain disruptions, labor strikes, pandemics, cyberattacks, or war.
7. Governing Law and Dispute Resolution
These Terms and Conditions shall be governed by and construed under the laws of the State of Nebraska, without regard to its conflict of laws principles. Any disputes arising from these Terms and Conditions shall be resolved exclusively in the courts of Nebraska or through binding arbitration, as determined by Drone Amplified.
8. Export Control and International Compliance
The purchaser agrees to comply with all applicable U.S. export control laws and regulations, including the Export Administration Regulations (EAR) and International Traffic in Arms Regulations (ITAR), as well as any laws in the purchaser’s jurisdiction.
The purchaser may not export, re-export, or transfer Drone Amplified products to any country, entity, or individual prohibited by U.S. law or any applicable international laws without obtaining prior authorization.
9. Limitation and Exclusion of Liability
IN NO EVENT SHALL DRONE AMPLIFIED, ITS AFFILIATES, DIRECTORS, EMPLOYEES, SUPPLIERS, OR LICENSORS BE LIABLE FOR CLAIMS, PROCEEDINGS, LIABILITIES, OBLIGATIONS, DAMAGES, LOSSES, OR COSTS IN ANY AMOUNT EXCEEDING THE AMOUNT PAID TO DRONE AMPLIFIED FOR THE PRODUCT OR SERVICE.
THIS LIMITATION APPLIES WHETHER THE CLAIM IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY.
10. Updates to Terms and Conditions
These Terms and Conditions are subject to change without prior notice. It is the responsibility of the customer to review and accept the most current terms before engaging in any transactions with Drone Amplified.
11. Store Credit
All store credit issued for returned merchandise or any other reason shall expire 365 days from the date of issuance. It is the customer’s responsibility to use the store credit within this period. Expired credit holds no cash value and will not be reissued.
